To Whom It May Concern:


We, the property owners living in Rutherford County, who are being considered for forcible annexation ask you to consider the following principles regarding property rights:

Tennessee State Constitution

Article I – Declaration of Rights

Sec.1 All power inherent in the people – Government under their control.

That all power is inherent in the people, and all free governments are founded on their authority, and instituted for their peace, safety,                   and happiness; for the advancement of those ends they have at all times, an unalienable and indefensible right to alter, reform or abolish the government in such manner they may think proper.

Sec.21 No man’s services or property taken without consent or compensation.

That no man’s particular services shall be demanded, or property taken, or applied to public use, without the consent of his representatives, or without just compensation being made therefore.

In the Declaration of Independence, Thomas Jefferson declared

"Governments are instituted among Men, deriving their just Powers from the Consent of the Governed." 

Ayn Rand, the author of Atlas Shrugged stated:

"The Right to life is the source of all rights - and the right to property is their only implementation.  Without property rights, no other rights are possible.  Since man has to sustain his life by his own effort, the man who has no right to the product of his effort has no means to sustain his life.  The man who produces while others dispose of his product is a slave." 

In The Second Treatise on Government (1690), John Locke argued:

“…if a man owns his own labor, he should also own the fruits of that labor.  The protection of these natural rights is the primary justification for the existence of government.”  As Locke stated, "The great and chief end therefore of men uniting into commonwealths, and putting themselves under government, is the preservation of property."  Locke also argued that if a ruler violates any of his subjects' property rights he is "at war" with them, and therefore the ruler may be disobeyed.

James Madison understood that the protection of property is the foundation of all freedoms when 

he said, 

"…a man is said to have a right to his property, he may be equally said to have a property in his rights. Where an excess of power prevails, property of no sort is duly respected. No man is safe in his opinions, his person, his faculties, or his possessions".

As you can see, our rights and privileges as property owners have a rich tradition that is undeniable. It is wrong to allow unelected “representatives” to violate the core values of the American experience. In addition, the plan of services proposed by the City of Murfreesboro fails to meet the criteria set forth by TITLE 6, Part 1 of Tennessee Code and does not justify the burden of a sixty percent tax increase.

We are concerned and troubled by these encroachments upon our rights. If this forced annexation stands, are you prepared to accept the possible, unintended consequences of such an arbitrary use of power? After all, Frederick Engels and Karl Marx, the founding fathers of communism, had this to say about property rights:

"…the theory of the communist may be summed up in a single sentence:  abolition of private property."  

Expansion of the city’s tax base is not a viable reason to forcibly annex us at the expense of our rights.  We, the citizens of Rutherford County, value our rights as property owners and ask for your support in preserving those rights.
